LAWSUIT

In February 2009, a class action was filed by the law firms of Higer Lichter & Givner, Podhurst Orseck and The Blumstein Law Firm on behalf of a Florida couple who purchased a new home constructed with the defective drywall. The lawsuit was filed against South Kendall Construction Corp. and Banner Supply Company.

The class action seeks to certify a class of all Florida residents who have purchased homes containing Chinese Drywall and who have suffered personal injury or property damage as a result.

The lawsuit seeks damages for both personal injury and property damages.
